JODY APOLOGIZES TO THE JUDGE


A federal judge today chastised police Supt. Jody Weis for "sending the wrong message" when he refused at first to turn over the names of officers who have at least five citizen complaints filed against them since 2000.

On Friday, Weis relented, following the judge's order and giving the names to lawyers representing a woman in an excessive-force case against the city.

That was enough to get U.S. District Judge Robert Gettleman to drop a contempt finding against Weis.

But the judge wasn't happy that Weis had delayed turning over the list. He ordered the city to pay the legal expenses of the plaintiffs' attorneys.

“No one is above the law,” Gettleman said.

He cited a 1928 Supreme Court decision that said: “If the government becomes a law-breaker, it breeds contempt for law. It invites every man to become a law unto himself. It invites anarchy.”

Weis apologized to Gettleman, saying his original decision to defy the court order was one of the "most difficult decisions I have made in my life."

"I just wanted to apologize if I offended the court in any way," said Weis, who was flanked by city attorneys.

In his original decision to refuse the court's order, Weis had written that handing over the roughly 2,500 names would "compromise officers' performance, threaten safety, reduce morale and improperly impugn many officers' otherwise well-deserved good reputations."

DEAR JODY YOUR THE WORST



I was excited when you were appointed I thought maybe things might change for the better but it is worse than ever.
All those meetings you had were all smoke & mirrors you were never concerned about our morale.

Why did you even waste our time?

Instead of pressuring the Mayor to find it in the budget to hire more Po's you decide to put a new unit up and take Po's out of the districts knowing we are short on manpower. Oh I'm sorry they are going to hire 200. It's not enough with the promotions & retirees this year .
You already have MSF & TRU use them.
Oh they did find 59 Million to buy 2,000 SUV's over the next 3 years for us .Which will not go to the Po's we always get the sloppy seconds or thirds.

How about thinning out 35Th St . How is it that these guys & gals with 2yrs on go right to 35Th after their probation. How about putting a stipulation of 5 yrs on before you can work @ 35Th st.

What about merit promotions ? Why is it that won't happen unless you have clout. What about all the good police officers that deserve merit but can't get it because they have no clout . The aldermen get to put people they want for merit like the people that donate to their campaigns or help with their fundraising parties. Why should an Alderman have any say in who get promoted?
Weren't you going to take applications for merit ?

Where were you when Mike Mette was in prison it took John Kass not you to get him out only after months of Kass columns about this in justice did you do anything.
Should I start on what you did to Bill Cozzi.

We are the second largest Police dept in this country but you sure as hell wouldnt know it with the crap equipment we have to use & cars.

You have done nothing for us.

WEIS HANDS THE LIST OVER


After being found in contempt of court by a federal judge, Police Supt. Jody Weis said today he has handed over a list of officers who have repeatedly been accused of misconduct.

Earlier this U.S. District Judge Robert Gettleman ordered Weis to appear in court Monday to explain why he has continued to defy the order.

"We have the chief law-enforcement officer of the City of Chicago basically picking and choosing the orders of the federal court that he will obey or disobey, and he's chosen to disobey this order," a transcript quoted Gettleman as saying.

Attorneys for Donna Moore, custodian of two minor children who claim they were beaten by an off-duty detective in 2007, have requested the city's list of "repeat officers," those accused more than five times of misconduct and all those accused of excessive force. Some officers have been accused as many as 65 times, including allegations of excessive force more than 20 times, said Flint Taylor, attorney for the plaintiffs.

Weis said he still disagrees with the judge's decision but feels he must comply. He plans to appear before the judge Monday morning.

TWO COPS FIRED ONE SUSPENDED


Two Chicago police officers were fired and a third was suspended in separate decisions released today by the Chicago Police Board.
John Dellorto was fired for using another officer's pass code to alter department computer data to inflate the number of arrests and awards he received over two years, according to the board's decision. The officer testified he did it as a joke, one he later regretted.

John Krupa III was fired for disobeying orders when he left a police station with a personal bag that a dog trained to detect drugs had alerted on during an earlier search of his car.

Linda Brumfield was suspended for seven months for pushing a towing company employee while off-duty after the company refused to waive a towing fee for her friend's towed car.

WEIS GUILTY OF CONTEMPT OF COURT


A federal judge found police Supt. Jody Weis in contempt of court today and gave him until 8:45 a.m. Monday to release the names of officers who have at least five citizen complaints filed against them since 2000.

Last month, Weis refused a magistrate judge’s order to turn over the papers, saying handing over the names would “compromise officers’ performance, threaten safety, reduce morale and improperly impugn many officers’ otherwise well-deserved good reputations.”

The list is being sought — along with a more specific list of officers with excessive-force complaints filed against them — by attorneys suing the city over an allegation that an officer falsely arrested and used excessive force against two children.

In her lawsuit, Donna Moore claims Officer Robert Smith falsely arrested her 11-year-old son and 13-year-old daughter in 2007 over a playground dispute involving Smith's son. Smith allegedly "physically attacked" the children before they were arrested.

Judge Robert Gettleman ordered Weis to be in court Monday if he does not intend to turn over the lists.

Mayor Daley has backed Weis' decision to not hand over the names.

Flint Taylor, a lawyer for Moore, had asked the judge to issue financial sanctions against the city because of the violation of the judge's order.

This morning, Gettleman accused lead city attorney Terrence Burns of making "incorrect" representations to the court, Taylor said in a prepared statement.

It was revealed in court that the lists include some officers with more than 60 complaints filed against them.

"We are very heartened by Judge Gettleman's strong reaction to Weis and the city's continuing lawless conduct and his finding that their conduct is directly contemptuous of the federal court," Taylor said. "We trust that the city will rethink its potion before Monday and produce the names. We also look forward to questioning Weis about his bad faith conduct and his policy of protecting, rather than rooting out, the department's worst repeaters."
